Terms of Service

These terms govern the sale and use of Tonarch licences. They are provided in English, which is the authoritative version. The licence itself is set out in full on the certificate you receive at purchase.

The service
Tonarch sells licences to play designed background-music soundscapes at commercial premises. On purchase you receive the audio files, a signed licence certificate naming the venue, and a repertoire annex listing the works.
Your licence
The certificate grants a non-exclusive, non-transferable right to play the licensed package publicly at one named location for the licence term. It may not be resold, sub-licensed, or transferred to other premises. The certificate’s clauses are the full and controlling terms of the licence; these Terms govern the sale and your use of the site.
Pricing, payment and renewal
- Prices are shown excluding VAT; VAT is added at checkout where it applies.
- Payment is processed by Stripe.
- Annual licences renew automatically each year until cancelled — you consent to this at checkout. You can cancel at any time; cancellation takes effect at the end of the current term. There are no refunds for partial terms.
- Lifetime licences are a single payment and do not renew.
What this licence is — and is not
The works are licensed directly from the rightsholder and are registered with no collecting society. Whether that affects any collecting-society fee you currently pay depends on the law of your market, which we have not reviewed for every territory — the certificate and the explainer set this out per market. This licence covers only the listed works; any other music you play at the premises (radio, TV, streaming, live performance, staff playlists) remains your own responsibility.
Warranties and liability
The service is provided “as is” to the fullest extent permitted by law. To that extent, we exclude implied warranties and limit our liability for the service to the amount you paid for the licence in question. Nothing in these terms limits any liability that cannot be limited by law, including for death or personal injury caused by negligence, or for fraud.
Governing law
These terms are governed by the laws of Poland, and the courts of Poland have jurisdiction, without prejudice to any mandatory consumer protections available to you in your country of residence.
Changes
We may update these terms; the current version always lives at this address, with the date above. Material changes affecting an active licence will be notified by email.
